Litigation

Summer knows her way around both California’s and the federal courts. She handles cases from start (pre-filing investigation) to finish (final judgment), including trial. Through her work as an arbitrator, Summer has a unique insight into the perspective of fact finders that makes her a particularly effective advocate in any courtroom or arbitration.

Representative Matters

  • Defended the owner of a cattle ranch in a trespass and nuisance claim brought by neighbors in relation to the alleged flow of water from the client’s property to the neighbors’ property.
  • Represented a solvent recycler in relation to impacts to soil, soil vapor, and groundwater allegedly resulting from the tenant’s past operations in a cleanup overseen by the Los Angeles Regional Water Quality Control Board (RWQCB). Defended litigation brought by a neighbor in trespass and nuisance to recover the alleged diminution in value of the neighbor’s property (allegedly) resulting from migration of the contamination.  Successfully appealed an RWQCB order that failed to name additional responsible parties.
  • Defended the owner of property overlying a plume of groundwater contamination originating from a Federal Superfund Site in response to a Special Notice Letter from the United States Environmental Protection Agency.  Defended the client in CERCLA litigation and represented the client in the associated allocation/settlement process.
  • Defended generator parties in a CERCLA action brought by the owner of a former used oil disposal site.
